Affiliates are responsible for accurate disclosure of their affiliate relationship per FTC guidelines, including clearly stating their commission-based incentive in promotional content.

Affiliate Terms & Conditions

By joining the ProCode Compliance Solutions Affiliate Program, you agree to abide by the following Terms & Conditions. These terms ensure a mutually beneficial partnership while maintaining the integrity of our brand and compliance with legal and ethical standards.
1. Eligibility & Enrollment

Affiliates must be 18 years or older to participate.

We reserve the right to approve or reject any affiliate application at our discretion.

Affiliates must not represent or be associated with companies that provide competing healthcare compliance services.
2. Commission & Payment Terms

Affiliates will earn a commission on successful sales made through their unique affiliate link.

Payments will be processed monthly through Direct Deposit.

Commissions are not paid on purchases refunded, disputed, or canceled.
3. Marketing & Promotional Guidelines

Affiliates may promote ProCode Compliance Solutions only through ethical and legal methods.

Prohibited marketing practices include:

False or misleading claims about our services.
-
Unapproved medical or compliance advice.
-
Implying an endorsement by government agencies.
-
Bidding on branded keywords in PPC campaigns (e.g., “ProCode Compliance” on Google Ads).

Use of spam tactics, including unsolicited emails and social media spam.
-
Any marketing that violates HIPAA, FTC advertising guidelines, or healthcare compliance regulations.

4. Use of Branding & Intellectual Property

Affiliates must use approved marketing materials provided by ProCode Compliance Solutions.

Any unauthorized use of our logos, trademarks, or brand assets will result in immediate termination from the program and will have legal ramifications.
5. Compliance with Laws & Regulations

Affiliates must comply with all applicable laws and regulations, including but not limited to:

HIPAA (Health Insurance Portability and Accountability Act)

FTC Truth in Advertising Guidelines

CAN-SPAM Act (for email marketing)

Affiliates are responsible for ensuring their promotional activities meet ethical and legal requirements.
6. Prohibited Conduct & Termination

We reserve the right to terminate any affiliate account at our discretion for:

Violation of these Terms & Conditions.

Misrepresentation of our services.

Engaging in fraudulent or deceptive practices.

Damaging the reputation of ProCode Compliance Solutions.

Upon termination, any unpaid commissions will be forfeited.
7. Limitation of Liability

Affiliates act as independent marketers and are not employees, partners, or legal representatives of ProCode Compliance Solutions.

ProCode Compliance Solutions is not liable for any claims, damages, or legal issues arising from an affiliate’s marketing activities.
8. Modifications to Terms

ProCode Compliance Solutions reserves the right to modify or update these Terms & Conditions at any time. Affiliates will be notified of significant changes.
9. Agreement & Acceptance
By joining the ProCode Compliance Solutions Affiliate Program, you acknowledge that you have read, understood, and agreed to these Terms & Conditions.
